Terms & Conditions
These terms govern your use of culture.anewagencyworld.com. Please read them before using the site.
01 Who we are
The website culture.anewagencyworld.com (the "Website") is operated by ANAW CommV, trading as A New Agency World ("ANAW", "we", "us"), Picardstraat 7/100, 1000 Brussels, Belgium, company number (KBO/BCE) 0843.793.892, RPR Brussels (Dutch-speaking division), VAT BE 0843.793.892, contact@anewagencyworld.com.
These Terms & Conditions ("Terms") apply to every visit to and use of the Website. By using the Website, you accept these Terms. If you do not agree with them, please do not use the Website.
02 What the Website is
The Website presents ANAW's activities in art and culture: our work for artists, brands, events and institutions, our art advisory services, and the artists and events we represent or work with.
The content is general information. In particular:
- No offer to sell. Artworks shown on the Website are presented for information. Their presence is not an offer for sale, and they may not be available. Any sale, loan, licence or commission is concluded only by a separate written agreement, which sets out the price, condition, provenance and other terms.
- No investment advice. Information about art, artists or the art market is not financial or investment advice. The value of art can go down as well as up, and past results are no guide to future value.
- Services by agreement. Our services, including art advisory, are provided under a separate written agreement, which prevails over these Terms.
03 Acceptable use
You may use the Website for lawful purposes only. In particular, you may not:
- copy, republish, sell, sublicense or otherwise commercially exploit content from the Website, including images of artworks, except as allowed in section 5;
- use robots, scrapers or other automated means to extract, mine or harvest content or data from the Website, including to train artificial intelligence systems or to generate images in the style of the artists shown. ANAW and the rights holders expressly reserve their rights to text and data mining within the meaning of article 4(3) of Directive (EU) 2019/790;
- try to gain unauthorised access to the Website, its servers or any connected system, or interfere with its operation, for example by introducing viruses or overloading it;
- use the contact form to send unsolicited advertising, unlawful content or content that infringes the rights of others;
- use the Website in any way that could harm ANAW, the artists and partners we work with, or other users.
We may block access to the Website for anyone who breaches this section.
04 Accuracy of the content
We take care to keep the Website accurate and up to date, including titles, dates, media and descriptions of artworks, but we cannot guarantee that all content is complete, correct or current at all times. Colours and proportions of artworks on screen may differ from the original. Please check information with us before you base a decision on it. We may change or remove content at any time without notice.
05 Artworks, photographs and other intellectual property
The artworks shown on the Website are protected by copyright, which belongs to the artists. Photographs of artworks, installations and events are protected by the copyright of the photographers, who are credited alongside their images. All other content, including texts, logos, the A New Agency World name and trademarks, the design and the underlying code, belongs to ANAW or to third parties who have licensed it to us. Names and logos of artists, festivals, institutions and partners are used with their permission or to identify them, and remain their property.
You may view the Website, print or save a page for your own non-commercial use, and share links to it. Any other use, including reproducing, adapting, distributing or publicly showing artworks or photographs, requires prior written consent from the rights holder. Press and image requests can be sent to contact@anewagencyworld.com, and we will pass them on where needed.
06 Links to other websites
The Website contains links to websites of third parties, such as those of artists, festivals and institutions. We do not control those websites and are not responsible for their content, availability or privacy practices. A link does not mean that we endorse the website or its owner.
07 Availability and security
We aim to keep the Website available and secure, but we do not guarantee that it will always be accessible, uninterrupted or free of errors, viruses or other harmful components. We may suspend, change or discontinue the Website, in whole or in part, at any time, for example for maintenance. Please use up-to-date security software when you browse.
08 Liability
The Website is provided free of charge, "as is" and "as available". To the extent permitted by law, ANAW is not liable for any damage resulting from the use of, or the inability to use, the Website or its content, or from relying on that content. This includes indirect damage such as loss of profit, revenue, data, business opportunities or reputation.
Nothing in these Terms excludes or limits our liability for intentional misconduct, fraud or gross negligence, for death or personal injury, or any other liability that cannot be excluded or limited under applicable law. If you use the Website as a consumer, you keep all rights that mandatory consumer law gives you.
09 Indemnity
If you use the Website in breach of these Terms or of the law, and a third party (such as an artist or photographer) makes a claim against ANAW as a result, you will compensate ANAW for the resulting damage and reasonable costs, including reasonable legal fees, to the extent permitted by law.
10 Privacy and cookies
How we handle personal data is explained in our Privacy Policy and our Cookie Policy.
11 Changes to these Terms
We may update these Terms from time to time. The version published on the Website, with its date, applies to your use of the Website from that date. Please check this page regularly.
12 General
- If any provision of these Terms is found invalid or unenforceable, the other provisions remain in force, and the invalid provision is replaced by a valid one that comes as close as possible to its purpose.
- If we do not enforce a right under these Terms straight away, we do not waive that right.
- We may transfer our rights and obligations under these Terms to another company, for example in a reorganisation. You may not transfer yours.
- These Terms may be published in several languages. If versions differ, the English version prevails, unless mandatory law provides otherwise.
13 Governing law and disputes
These Terms are governed by Belgian law. Disputes are subject to the exclusive jurisdiction of the courts of Brussels. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may also bring proceedings in the courts there.
